"After reviewing the case, we've declined to file any charges due to insufficient evidence," says DA spokeswoman Jane Robison.Following the crash, the 22-year-old Transformers star was cited with misdemeanor DUI while he was still at the hospital.Prosecutors instead plan to file criminal charges against the other driver, who was found to have run a red light, Robison says."We're very happy with the prosecutor's decision, and we're glad this whole thing resolved without Shia having to go to court," LaBeouf's attorney Michael Norris tells PEOPLE
There’s not enough evidence because Shia refused to take a blood alcohol test at the scene. And the cops can’t make him. Which makes total sense. Who put them in charge of a crime scene anyway? Do we really want the cops "policing" our every move? I think not. This way is much better.
