On October 12, 2005, a woman named Zeta Graff filed a lawsuit (read it here) against Paris Hilton claiming Hilton fed a story she knew to be false to the New York Post. The Post then printed the story which said that Graff attacked Hilton in a London nightclub and attempted to rip a multi-million dollar necklace off of Hiltons neck before club security threw Graff out. That was according to Hilton. In reality, none of it happened. Hilton was the only source for the story, but was not named as such. At the time, Hilton was dating and maybe even engaged to Paris Latsis, who was the ex-boyfriend of Graff. Fast forward to today, where the suit filed by Graff is finally coming to court. Except it's not, because a psychiatrist hired by Hilton has said she is unfit to deal with the stress of her trial because of her upcoming 45 day jail sentence. The original date was set for May 16th. It has now been reset for August 22nd. TMZ says:
According to a declaration filed by Dr. Charles Sophy, Hilton is "not capable of any meaningful participation" in a civil trial brought against her by diamond heiress Zeta Graff. Paris' shrink claims that Hilton is "emotionally distraught and traumatized" from the May 4 hearing where she was sentenced to 45 days in jail for breaking probation in her DUI bust, and asked a judge to allow her sufficient time to recover. In the document, the head-doc goes on to explain that Hilton "Cannot effectively respond to examination as a witness or provide any significant input into her defense." In fact, Sophy claims that forcing Paris to participate on May 21 would "exacerbate her current mental condition."
So the new trial should be a little more than a month after she gets out, if she stays all 45 days. Which she won't. Hopefully she'll be up to the task by then, poor little lamb, because you know those judges. Stubborn stubborn stubborn. It's trial this and trial that. Those guys are real jerks!
